Murdoch’s Gift Card Sweepstakes | January 2020
Participation in the sweepstakes constitutes each entrant’s full and unconditional agreement to and acceptance of these official rules, which are final and binding.
Winning a prize is contingent upon complying with these Official Rules and fulfilling all contingencies to win, which are fully described herein.
Winner will be required to respond to winner notification according to these Official Rules to be finally qualified to receive a prize award.
No purchase or payment of any kind is necessary to enter or win this sweepstakes.
All federal, state, local, and municipal laws and regulations apply. Void where prohibited.
Sponsor: Ranch and Home Supply, LLC dba Murdoch's Ranch & Home Supply (“Murdoch’s”), 2311 North 7th Avenue, Bozeman, Montana 59715.
Eligibility: Entrants must be 18 years or older at the time of entering the Sweepstakes and a legal resident of the United States of America. To be eligible, each entrant via sign-up to the Murdoch’s newsletter (see below) must have opened or clicked a link within a Murdoch’s newsletter within the 3 months preceding the selection of a winner on January 24, 2020. The following are not eligible to enter the Sweepstakes: owners, employees, and legal agents of Murdoch’s or any of its parent, subsidiary, or affiliate companies; the immediate family of such owners, employees, and legal agents (including parents, grandparents, spouses, children, grandchildren, and siblings) and persons domiciled with them.
How to Enter: To enter the Sweepstakes, sign up for the Murdoch’s newsletter email and enter the contest online at https://www.murdochs.com/newsletter/gift-card-sweepstakes/gift-card-sign-up-confirmation/. Mail-in entry to the Sweepstakes may be completed by sending a written request, along with a self-addressed, stamped envelope, to Murdoch's Ranch & Home Supply, Attn: Marketing/Gift Card Sweepstakes, at 2311 North 7th Avenue, Bozeman, Montana, 59715. Such mail-in entry must be received by Murdoch’s by January 19, 2020. Proof of mailing is not proof of receipt by Murdoch's and not proof of Sweepstakes entry. Regardless of method, only one entry per person.
Winner Selection: One Sweepstakes winner will be chosen at random on or before January 24, 2020 at a time within the Sponsor’s sole discretion. The random selection will be performed solely by the Sponsor and shall be final and not subject to appeal.
Odds of winning depend on total number of entries received by all eligible entrants. No purchase or payment of any kind will increase an entrant’s chances of winning.
Winner Notification and Confirmation: The first randomly selected winner will be notified by phone or email (as provided) on or before January 24, 2020. To claim the prize award, the winner must confirm his/her identity as an eligible entrant by providing his/her first and last names and age in an email to customerservice@murdochs.com or phone call to 1-855-232-9104 within 2 weeks of notification. If the winner fails to provide confirmation, the prize award will be forfeit and the Sponsor will randomly select another winner from the eligible entries submitted prior to the first random selection. The process of winner notification and confirmation will continue until a winner properly confirms his/her identity or the Sponsor decides to terminate the Sweepstakes without award after 3 unsuccessful attempts. Confirmation by the winner constitutes permission for the Sponsor to use the winner's first and last names and city and state of residence without compensation for purposes of advertising and promotion for the Sponsor, unless prohibited by applicable law.
Prize Award: One (1) $250 Murdoch’s Gift Card will be awarded to the randomly selected winner who provides the proper confirmation (see above). This prize award is not redeemable for cash. Taxes on any prize award are the sole responsibility of the winner. No cash equivalents, substitutions, or transfers. Notwithstanding, the Sponsor, at its sole discretion, may substitute a prize award of equal or greater value.
Confidentiality: Entry into the Sweepstakes will place each entrant on the distribution list to receive the Murdoch’s newsletter email. Each entrant may unsubscribe at any time by clicking on the unsubscribe link at the bottom of the Murdoch’s newsletter email. The first name, last name, city, and state of the winner may be announced in Murdoch's email newsletter, website, Facebook pages, and press releases. Disqualification: Those entrants will be disqualified who violate any of these Official Rules, gain unfair advantage in participating in the Sweepstakes, or obtain winner status using fraudulent means.
Governing Law: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules and/or any and all aspects of the Sweepstakes will be governed by and construed in accordance with the internal laws of the State of Montana, without giving effect to any choice of law or conflict of law rules or provisions.
Sponsor’s Decisions Final: By participating, each entrant agrees to be bound by the decisions of the Sponsor. The Sponsor will interpret these Official Rules and resolve any and all disputes, conflicting claims, and/or ambiguities concerning any and all aspects of the Sweepstakes. In its sole discretion, the Sponsor may waive any of the requirements in these Official Rules. The Sponsor may modify these Official Rules or suspend or terminate the Sweepstakes without award if the conduct or outcome of the Sweepstakes is affected by any condition that undermines the purpose and fairness of the Sweepstakes, as determined in the sole discretion of the Sponsor, including the following: human error; intentional interference; mechanical, electrical, communications, network, Internet, hardware, or software malfunction or failure; or any other event outside the Sponsor’s control. All decisions by the Sponsor concerning any and all aspects of the Sweepstakes are final, binding, and not subject to appeal.
Sponsor’s Non-Liability: The Sponsor is not responsible for any failures that occur or losses sustained related to the Sweepstakes, including those that relate to the following: lost, late, or illegible entries; transmission issues or errors resulting in omission, interruption, deletion, defect, or delay of entries; theft, destruction, unauthorized access to, or alterations of entry materials and information (including personal information); mechanical, electrical, communications, network, Internet, hardware, or software malfunction or failure.
Disputes: By participating in the Sweepstakes, each entrant agrees to the following provisions regarding disputes and claims arising from the Sweepstakes.
Except where prohibited by law: (i) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes will be resolved individually, without resort to any form of class action; (ii) each entrant knowingly, expressly, and irrevocably waives any right to seek injunctive or equitable relief, limiting all remedies to a claim for money damages; (iii) any and all claims, judgments, and awards will be limited to actual out-of-pocket costs incurred, not to exceed two hundred fifty dollars ($250.00), and not to include attorney fees and/or costs of court; (iv) each entrant knowingly, expressly, and irrevocably waives all rights to, and shall under no circumstances be permitted to seek or obtain, the following: indirect, incidental, consequential, special, or punitive damages; any kind of damage multiplier that would increase the total award of damages above two hundred fifty dollars ($250); (v) each entrant knowingly, expressly, and irrevocably waives the right to a jury trial.
Entire Agreement: These Official Rules constitute the entire agreement between the Sponsor and each entrant concerning any and all aspects of the Sweepstakes. These Official Rules supersede and cancel any and all other statements, agreements, and/or understandings concerning any and all aspects of the Sweepstakes, except as the Sponsor may modify these Official Rules in its sole discretion and according to the foregoing provisions.
